What is Carnal Knowledge of a Child?
Under Virginia law, it is illegal to have carnal knowledge of a child between 13 to 15 years of age. Known as the “carnal knowledge statute,” this law prohibits all sexual acts between a minor and a defendant of any age, from intercourse to anal and oral sexual contact.

What are Carnal Knowledge Laws in Virginia?
Under Virginia law, carnal knowledge is defined as acts of sexual intercourse, oral sex, or sexual penetration with an object involving children aged 13 through 15.
It is a Class 4 felony to engage in sexual conduct without force with this age group by an adult.
- If carnal knowledge occurs with a 13 through 15 year-old without force by someone who is also a minor and if the alleged victim is three or more years younger than the accused, it is classified as a Class 6 felony. This charge carries penalties of one year up to five years in prison or one month up to one year in jail and a fine of up to $2,500.
- If the alleged victim is less than three years younger than the accused minor, it is classified as a Class 4 misdemeanor which is punishable by a fine of up to $250.
- If you are above 18 and have sex with a minor who is 13 or 14, this Class 4 felony carries a penalty of two to 10 years in prison and / or a fine of up to $100,000.
It doesn't matter in any of these cases whether the sexual act was consensual. It is considered to be statutory rape. If convicted of carnal knowledge in such a case, you may be required to register as a sex offender which can have a major negative impact on your life and future.
