Penalties for Driving on a Suspended License in Virginia

Under Section 46.2 – 301 of Virginia law, driving on a suspended or revoked license is a Class 1 misdemeanor. This offense carries potential penalties of up to a year in jail and / or a fine of up to $2,500. Your vehicle may also be impounded for up to 90 days upon a conviction. All costs connected with the impoundment, including removal and storage fees, will be owed by you. You will also face the potential for a new license suspension for the same amount of time as your original suspension, which could be for another 90 days. Thus, you will have to serve two license suspensions back to back.

In cases where a third or subsequent conviction of this offense has occurred within 10 years, you will face a mandatory minimum jail sentence of 10 days. Your license can be suspended for a failure to pay traffic fines or costs in connection with earlier traffic offenses or criminal convictions.

In the case of a suspended license, you can petition the court for authorization to obtain a restricted license.
