What are Virginia’s Marijuana Laws?

What is the Penalty for Possession of Marijuana in Virginia?

  • A first offense of possessing less than half an ounce of marijuana for your own personal use is charged as a misdemeanor in Virginia. This charge is punishable up to 30 days in jail and a fine of up to $500.
  • A subsequent offense is also charged as a misdemeanor with penalties of up to a year in jail and a fine of up to $2,500.

Probation and Treatment Programs

Under Virginia law, however, you may be eligible for a case dismissal providing you complete a probation and treatment program. You will still be subject to a six-month driver's license suspension which Virginia imposes under a 1991 law.

The probation and treatment program is generally for first offenders who are required to pay for part of the entire program out of their own pocket based on their financial ability. Costs can include expenses for screening, testing, treatment and/ or education. The individual must successfully complete the entire program and while on probation must remain drug free which is determined through drug testing. The program also includes community service hours. If the individual does not comply with all terms of the probation or drug program, he or she will be subject to a guilty charge by the court followed by its decision as to sentencing.
