Expungement of Records

The process and likelihood of having your record expunged will vary greatly depending upon the specific facts of your case. If you were convicted or entered a plea of guilty to a charge in Virginia, you are not eligible for expungement. Expunging records is actually a civil, not a criminal, proceeding. Essentially, one who seeks to have an arrest expunged from their record must file an action in civil court against the Commonwealth of Virginia to make that happen.

The process of expunging a record can be quite complex. Courts are looking for certain factors when they determine whether an arrest ought to be expunged. We are all presumed innocent until proven guilty in a court of law, but that doesn’t mean that an arrest for which you were never convicted can't be a heavy burden.
